These Terms of Use ("Terms") govern your access to and use of the website cybrainx.com and all Cybrainx mobile applications (collectively, the "Services"), operated by Cybrainx ("we", "our", or "us").

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Services.

1. Eligibility

You must be at least 13 years of age to use our Services. By using the Services, you represent and warrant that you meet this minimum age requirement. If you are under 18, you should review these Terms with a parent or guardian.

2. License to Use

Subject to your compliance with these Terms, Cybrainx grants you a limited, non-exclusive, non-transferable, revocable license to download and use our mobile applications for your personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of our Services;
• Reverse engineer or attempt to extract the source code of any application;
• Use the Services for any unlawful or fraudulent purpose;
• Attempt to gain unauthorized access to any portion of the Services or related systems.

3. In-App Purchases and Subscriptions

Some features of our apps may be available through paid subscriptions or one-time purchases. All transactions are processed by the respective app store platform (Google Play or Apple App Store) and are subject to their terms and conditions.

Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your app store account settings.

Refund Policy: Refund requests must be made directly to Google Play or the Apple App Store according to their respective refund policies. Cybrainx does not independently process refunds.

4. Advertising

Our free-tier apps may display advertisements served by third parties, including Google AdMob. These ads are subject to the advertiser's own terms and privacy policies. We are not responsible for the content of third-party advertisements.

5. Intellectual Property

All content within the Services — including text, graphics, logos, icons, images, software, and other material — is the exclusive property of Cybrainx or its content suppliers and is protected by applicable intellectual property laws.

These Terms do not grant you any right to use Cybrainx trademarks, trade names, or service marks.

6. User Conduct

You agree to use the Services only for lawful purposes. You must not:

• Upload or transmit any content that is harmful, offensive, defamatory, or illegal;
• Engage in any activity that disrupts or interferes with the Services;
• Use automated scripts or bots to access or interact with the Services;
• Impersonate any person or entity.

7. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Cybrainx shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or profits — arising out of or related to your use of the Services.

9. Third-Party Links and Services

Our Services may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.

10. Termination

We reserve the right to suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or the interests of Cybrainx.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Belo Horizonte, Minas Gerais, Brazil.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Services after changes constitutes your acceptance of the new Terms.
