These Terms of Use govern your access to and use of the SmartNoteAI application and related services provided by Cybrainx. By downloading, installing, creating an account, or otherwise using the app, you agree to be bound by these terms.

SmartNoteAI is intended for personal productivity, note organization, and AI-assisted assistance. The app is not intended to replace professional legal, medical, financial, or other qualified advice.

1. Eligibility and account use

You must be at least the minimum age required by applicable law or platform policy to use the app. If you create an account, you are responsible for keeping your credentials secure and for all activity that occurs under your account.

2. License

Cybrainx grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for lawful purposes on your device in accordance with these terms. You may not copy, reverse engineer, resell, redistribute, or attempt to extract the source code or underlying systems of the app except where such use is expressly permitted by law.

3. Acceptable use

You agree not to use SmartNoteAI to upload, store, process, or share content that is unlawful, harmful, infringing, deceptive, obscene, or otherwise violates the rights of others. You are responsible for the content you create, save, upload, or request the app to process.

4. AI-generated content and limitations

SmartNoteAI may provide AI-assisted features such as summaries, suggestions, categorization, and content assistance. These outputs are generated automatically and may be incomplete, inaccurate, or not suitable for every purpose. You should review all AI-generated content before relying on it for important decisions.

AI functionality may rely on third-party services, including an OpenRouter API connection processed through a Cloudflare Worker, and the resulting output is provided for informational support only.

5. In-app purchases, subscriptions, and app store terms

SmartNoteAI may offer paid features or subscriptions. Purchases are processed through the relevant app store platform, such as Google Play or the Apple App Store, and are subject to the terms and policies of those platforms. Subscription renewals, billing, refunds, and cancellations are managed by the applicable app store provider, unless otherwise stated by Cybrainx.

6. Ads and third-party services

The app may display advertisements through AdMob and may use analytics, authentication, infrastructure, and cloud services provided by Firebase, Google Analytics, Google Cloud, and Cloudflare Workers. These services are used to support app performance, reliability, analytics, advertising, and AI processing workflows.

Your use of the app is also subject to the applicable policies of the platform where you install and use it, including Google Play and Apple App Store requirements.

7. Privacy and data handling

Your use of the app is also governed by our Privacy Policy. By using SmartNoteAI, you acknowledge that your data may be processed in accordance with that policy, including through the third-party services listed above.

8. Intellectual property

The SmartNoteAI name, app design, interface, branding, and related content are owned by Cybrainx unless otherwise noted. You may not copy, distribute, or exploit protected elements of the app without permission.

9. Availability and updates

Cybrainx may update, improve, suspend, or discontinue features or services at any time, including temporary outages or changes in availability. We may also update these terms and the app’s features from time to time.

10. Disclaimer of warranties

SmartNoteAI is provided “as is” and “as available.” We do not guarantee that the app will be uninterrupted, error-free, or suitable for every purpose. To the extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

Cybrainx, its affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the app, including loss of data, loss of productivity, or any other damages, except where prohibited by law.

12. Governing law and contact
